Today was published in Diário da República the Decree-Law 80/2019, of 17 June. This Decree-Law amended DL 98/2010 of 26 July and establishes the principles and rules necessary to simplify the free access and exercise of service and establishment activities of any person or company of the European Union within the national territory.
As regards the exchange of services, this Decree-Law aims to prevent traders from applying different general conditions of access to their goods and services to customers in other Member States wishing to transact. It prohibits discrimination relating to means of payment and terminates distribution agreements that prohibit passive sales in specific situations within its scope.
The title of the latter Decree Law states: “… the freedom to provide services and establishment of any person or undertaking of the European Union within the national territory is recognized. This will deepen the process of European integration and consolidation of the single market.
With these measures, in addition to the competitiveness of the services market, consumers are also guaranteed greater transparency and information, providing them with a broader, diversified, and superior quality offer at lower prices.”.
