AIMA obliged to comply with 90-day deadline for the Supreme Court to grant residency

AIMA faces a significant overload of cases, including applications for citizenship or residence, which contribute to a chaotic scenario at the agency’s door and in the lives of migrants who wait indefinitely for answers to their requests.

This slow processing has led to public criticism and the need for structural solutions for immigration in Portugal, such as those announced today.

Granting residence – strengthening legislative measures

Supreme Court decision to reinforce AIMA deadlines announced: The Supreme Court recently imposed a mandatory 90-day deadline for AIMA to decide on residence permits.

The aim is to reduce uncertainty for migrants who, while waiting for a residence permit, find themselves in a very delicate situation, unable to find work, go to school, or make any kind of definitive decision.

The most urgent cases that resorted to legal action under this 90-day deadline, which had already been considered in the law, were often ignored or rejected. From now on, they will be taken more seriously, which will be crucial to ensuring migrants’ rights within the legal time limits.

 

Complementary Measure – creation of a new Immigration and Asylum Court

The proposal made to the government to create an Immigration and Asylum Court has been accepted: in response to the crisis, it has been announced that a new court will be set up, in Lisbon for the time being. This specialized court will streamline immigration and asylum processes, providing faster decisions (such as those granting residence) and fairness for applicants.

This measure is a direct response to the need to unburden the system and guarantee proper handling of immigration cases.
