The conditions of access to the Golden Visa Program in 2023 will not change significantly in relation to the rules currently in force.
At the beginning of the year – more precisely on January 1, 2022 -, the Assembly of the Republic already had authorized the revision of the conditions of access to the Portuguese Golden Visa, in relation to what had been defined since 2020. These changes were approved in Decree-Law no. 14/2021 of 12 February, which made investors aware of the program’s new rules.
One of these reviews focuses on the required investment amount that would be eligible to obtain the residence permit. This value was already increased in early 2022 and will remain so.
What else holds in the Golden Visa 2023?
Real Estate Investment:
- Real estate investment will continue to be suitable but only if carried out in the territories identified here, or in the autonomous regions of the Azores and Madeira.
Capital transfer:
The capital transfer rules are also maintained under the following conditions:
- The transfer of capital to Portugal, destined for the acquisition of units of participation in investment funds or risk capital geared towards capitalization of companies. This applies if they are formed under the Portuguese legislation, whose maturity, at the time of the investment, is at least five years old.
At least 60% of the value of investments must be made in companies headquartered in national territory and will continue to have a minimum amount of €500,000;
- The incorporation of a commercial company, headquartered in the national territory and combined with the creation of five permanent jobs.
It will also be valid for reinforcing the share capital of a commercial company with registered office in national territory, already constituted, with the creation or maintenance of jobs, with a minimum of five permanent members, and for a minimum period of three years, in amount equal to or greater than €500,000;
- The transfer of capital applied in research activities carried out by public or private institutions of scientific research, will remain with a value minimum of €500,000.
