Holders of a residence permit in Portugal enjoy the same rights as Portuguese nationals, with some exceptions with regard to the exercise of public and political duties, and are entitled to:
In principle, and without prejudice to the special conditions for granting visas, foreign citizens who are not prohibited from entering Portugal, have means of subsistence, a valid travel document and travel insurance are entitled to obtain an entry visa to Portugal.
But in effect, there are many factors on which obtaining a visa or residence permit depends, such as the absence of a criminal record, registration with the Tax Authority and Social Security, opening a bank account and others.
Thus, after a preliminary analysis to frame the type of process, it is crucial to have the details and documents carefully analysed by an experienced professional to ensure the success of the whole process.
Portuguese law requires, in most cases, that foreign nationals from countries outside the European Union present a visa to enter Portugal.
This visa, depending on the objectives/intentions of the foreign citizen, may be: short-stay, temporary stay or residence.
Relativamente ao período de validade, a autorização de residência compreende dois tipos:
a) Autorização de residência temporária
É válida pelo período de um ano contado a partir da data da emissão do respetivo título e é renovável por períodos sucessivos de dois anos;
b) Autorização de residência permanente
Não tem limite de validade e não está ligada a uma finalidade específica, o que significa que o seu titular pode exercer qualquer atividade lícita. Também é necessário que o Requerente, entre outros requisitos, seja titular de autorização de residência temporária há pelo menos cinco anos.
Citizens with a valid residence permit (temporary or permanent) are entitled to family reunification, which can be requested at the same time as the residence permit.
Who is entitled to reunification:
a) Family members who are outside Portugal, who have lived with the applicant in another country, who depend on him/her or who live with him/her, regardless of whether the family ties are prior or subsequent to the resident’s entry.
b) In the same circumstances, family members who are legally in Portugal and who are dependent on or cohabiting with the holder of a valid residence permit.
Note: The refugee, recognised under the terms of the law governing asylum, has the right to family reunification with the members of its family who are in Portugal or abroad, without prejudice to the legal provisions recognising the refugee status of family members.
Brazilian citizens can also benefit from the Equality Statute by adding even more benefits than those enjoyed by foreign citizens with a residence permit.
