Legal resident for five years

For whom it is intended:

Foreigners who have legally resided in Portugal for 5 years, provided that at the time of the application they still have legal residence in Portugal.

The new amendment to the law allows the period from the application for temporary residence permit until its approval to also be counted towards obtaining nationality, provided it is approved.

Even if the five years of residence are not consecutive, they will be counted as long as they fall within the last fifteen years.

Obtains derived citizenship, but can transmit Portuguese nationality to their spouse, common-law partner, and minor children.

Requirements:

  • Has legal residence in Portugal at the time of application;
  • Has been legally resident in Portugal for five years (consecutive or interpolated within the last fifteen years);
  • Is over 18 years of age or emancipated according to Portuguese law;
  • Not having been convicted with a final judgement for an offence punishable by a prison sentence of three years or more, according to Portuguese law;
  • Not having been involved in terrorism-related activities;
  • Has sufficient knowledge of the Portuguese language (e.g. by obtaining a grade of 50% in an A2 level exam), with the exception of nationals of Portuguese-speaking countries and some others.
  • Compile, among others, the following documents:
    • Identification document
    • Birth certificate
    • Portuguese birth certificate
    • Test of adequate proficiency in the Portuguese language;
    • Criminal record of the country of birth and citizenship and of all countries where the applicant has resided after 16 years;
    • Photocopy of the residence card in Portugal

We will analyse and compare birth certificates and proof of residence documents, taking the opportunity to detect any inconsistencies in the documents that may impede the process.

Process:

  1. Framing the entitlement and determining the best strategy for the client and their family.
  2. Guidance on the issue and legalisation of foreign documents by the client.
  3. Submission of the file to the competent registry/court/sector in Portugal and regular monitoring of progress.
  4. Sending the final document to the client – be it the judgement, the civil registration certificate (birth, marriage, death), etc.

* In the citizenship process the client receives a certificate of the Portuguese birth certificate and has the obligation to request the issuance of the ->Citizen Card-> and in possession of the latter, if desired, it can also request the issuance of the ->Portuguese Passport->. Both documents can be issued at the Portuguese Embassy and/or Consulate or directly in Portugal. Ask us how.
