Portuguese Citizenship

Legal action to recognise a common-law marriage

For whom it is intended:

Individuals who wish to have their common-law marriage duly recognised in Portugal for the purpose of applying for Portuguese Citizenship through it.

If previously there were reviews of foreign judgements (and even of Deeds) of the Common-law marriage, today it is clear from the law and case law that the citizenship process should only be instructed with a court judgement handed down in a civil action to be brought against the Portuguese State.

It is a legal action that requires the assistance of a lawyer and can only be brought in Portugal.

Requirements:

  • Living in a Common-law marriage – in Portugal, the common-law marriage is the legal situation of two people who, regardless of sex, live in conditions similar to those of spouses.
  • Prove, with the possibility of using documents and statements, that both parties are in a common-law marriage.
  • Compile, among others, the following documents:
    • Identification documents
    • Portuguese birth certificate
    • Other documents to prove the claim

We will analyse and compare birth certificates and proof of residence documents, taking the opportunity to detect any inconsistencies in the documents that may impede the process.

Process:

  1. Framing the right and determining the best strategy for the client and their family.
  2. Guidance on the issue and legalisation of foreign documents by the client.
  3. Submission of the file to the competent registry/court/sector in Portugal and regular monitoring of progress.
  4. Sending the final document to the client – be it the judgement, the civil registration certificate (birth, marriage, death), etc.

* In the citizenship process the client receives a certificate of the Portuguese birth certificate and has the obligation to request the issuance of the ->Citizen Card-> and in possession of the latter, if desired, it can also request the issuance of the ->Portuguese Passport->. Both documents can be issued at the Portuguese Embassy and/or Consulate or directly in Portugal. Ask us how.
