Judicial Action for Opposition to Portuguese Nationality

For whom it is intended:

Individuals who have undergone a citizenship procedure by effect of will in one of the following cases:

Minor or incapacitated child of an alien who acquired citizenship after birth
Marriage or common-law marriage
Reacquisition of citizenship

And they were notified of legal action opposing citizenship, because the Registrar considered that there were ->facts that could justify opposition to the acquisition of citizenship->, and duly informed the Public Prosecutor’s Office of this.

It is a legal action that requires the assistance of a lawyer in which the Public Prosecutor’s Office, representing the Portuguese State, has to allege and prove the facts about which it has knowledge that prove that the applicant has no connection to the community or one of the other impediments listed in Article 9 of the Nationality Law:

their connection to the community citizenship
the exercise of public functions not predominantly of a technical nature, and
the provision of non-compulsory military service to a foreign state.

Requirements:

Was notified in the context of a citizenship procedure by effect of will in one of the following cases:
- Minor or incapacitated child of an alien who acquired citizenship after birth
- Marriage or common-law marriage
- Reacquisition of citizenship
Compile, among others, the following documents:
- Identification documents
- Photocopy of citizenship file
- Notification of the court

We will analyse and compare birth certificates and proof of residence documents, taking the opportunity to detect any inconsistencies in the documents that may impede the process.

Process:

Framing the right and determining the best strategy for the client and their family.
Guidance on the issue and legalisation of foreign documents by the client.
Submission of the file to the competent registry/court/sector in Portugal and regular monitoring of progress.
Sending the final document to the client – be it the judgement, the civil registration certificate (birth, marriage, death), etc.

* In the citizenship process the client receives a certificate of the Portuguese birth certificate and has the obligation to request the issuance of the ->Citizen Card-> and in possession of the latter, if desired, it can also request the issuance of the ->Portuguese Passport->. Both documents can be issued at the Portuguese Embassy and/or Consulate or directly in Portugal. Ask us how.
