Foreign divorce in Portugal

For whom it is intended:

Foreign citizens residing in Portugal who, even if the marriage was celebrated abroad, wish to dissolve the marriage.

It is possible provided that at least one of the spouses resides in Portugal, even if the marriage was celebrated abroad and even if both spouses are foreigners.

Requirements:

Depending on the type of divorce the requirements are different.

There are three types of divorce:

divorce by mutual consent at the civil registry office – provided that both agree.
divorce by mutual consent in court, if both agree on divorce but not on the terms of it.
divorce without consent of one spouse in court when there is no agreement and only one spouse wants to end the marriage

In addition to divorce, there is also the Separation of Persons and Property, which does not end the marriage but changes the property regime, and the duty to live together and to contribute to the common life ceases to exist. Separation of persons and property ends if there is a reconciliation, but it can also be converted into divorce if both parties wish. It can be applied for at the registry office, if agreed, or in court.

Process:

Framing the right and determining the best strategy for the client and their family.
Guidance on the issue and legalisation of foreign documents by the client.
Submission of the file to the competent registry/court/sector in Portugal and regular monitoring of progress.
Sending the final document to the client – be it the judgement, the civil registration certificate (birth, marriage, death), etc.

* In the citizenship process the client receives a certificate of the Portuguese birth certificate and has the obligation to request the issuance of the ->Citizen Card-> and in possession of the latter, if desired, it can also request the issuance of the ->Portuguese Passport->. Both documents can be issued at the Portuguese Embassy and/or Consulate or directly in Portugal. Ask us how.
